1. Introduction

Welcome to CarbScanner. These Terms of Service ("Terms") govern your access to and use of the CarbScanner mobile application and related services (collectively, the "Service"). By downloading, accessing, or using CarbScanner, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of the Service

CarbScanner is a mobile application that uses software and artificial intelligence to provide estimated nutritional information, including carbohydrate estimates for food and meals. You can snap pictures of food or enter meal information, and the app may display an estimated breakdown of items and nutrients, along with related informational insights (such as glycemic index information, when available). CarbScanner may also allow you to store and view your past scans and entries.

The Service is provided for informational and wellness purposes only.

3. Medical Information Disclaimer & User Responsibility

Nothing on the Service is intended to provide medical, dietary, or other professional advice. Any information presented (including carbohydrate estimates and related insights) is provided for informational purposes only and is not intended as a substitute for advice provided by a doctor or other qualified healthcare professional. You must not use the Service to diagnose a health problem or disease, or to make decisions regarding medical treatment.

The Service is not a medical device and is not intended to manage, diagnose, treat, cure, or prevent any disease. You should always consult your physician or another qualified healthcare professional regarding any medical condition or treatment, and before making changes to diet, medication, or lifestyle.

CarbScanner provides best-effort estimates that may be incorrect, incomplete, or unsuitable for your circumstances. You are solely responsible for verifying information and for how you use the Service, including reviewing and adjusting items, servings, and results to match what you consumed. Do not rely on the Service as the sole basis for any decision.

Under no circumstances should the Service be used to calculate insulin doses or determine bolus amounts. CarbScanner does not provide data suitable for medical decision-making.

4. No Liability for Misuse or Reliance

CarbScanner is provided with the clear and repeated notice that all results are estimations and may be inaccurate. By using the Service, you acknowledge and agree that you assume all risk arising from your use of, or reliance on, the Service and that CarbScanner cannot and does not accept responsibility for:

• Any harm, injury, or adverse event resulting from your reliance on estimated nutrition information (including carbohydrate estimates and any insights).
• Any errors, omissions, or inaccuracies in the estimations provided by the app.
• Any decisions you make (medical or otherwise) based on information from the Service.
• Any use of the Service for insulin dosing, bolus calculations, or any other medical treatment decision.
• Any misuse of the Service, including use contrary to professional advice.

To the fullest extent permitted by applicable law, CarbScanner and its owners, developers, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of, or inability to use, the Service.

5. Eligibility & User Account

You may use CarbScanner only if you are able to form a binding contract with us under applicable law. If you are under the age of 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

You are responsible for maintaining the confidentiality and security of any device or credentials you use to access the Service and for all activities that occur under your usage.

6. CarbScanner Premium & Subscription Terms

CarbScanner offers a premium subscription ("CarbScanner Premium") after an initial free trial period. You may use the Service for up to 10 scans free of charge. After these 10 free scans, continued access to scanning features requires an active CarbScanner Premium subscription.

The current price for CarbScanner Premium is 4.95 EUR per month (or the equivalent in your local currency, as determined by the app store or payment provider). By subscribing, you authorize the applicable app store or payment provider to charge you the subscription fee on a recurring monthly basis until you cancel.

Subscriptions automatically renew each month unless cancelled at least 24 hours before the end of the current billing period (or as otherwise specified by the app store or payment provider). You can cancel your subscription at any time via your app store account settings or through your account on carbscanner.com. Deleting the app does not automatically cancel your subscription.

Prices and features of CarbScanner Premium may change from time to time. Any changes will apply to future billing periods and, where required by law, we will provide notice in advance.

7. Acceptable Use

You agree not to use the Service in any way that is unlawful, harmful, fraudulent, or otherwise objectionable, including but not limited to:

• Attempting to reverse engineer, decompile, or otherwise access the source code of the app.
• Interfering with or disrupting the operation of the Service or its servers.
• Using the Service in a way that violates applicable laws or regulations.

8. Intellectual Property

All content, features, and functionality of CarbScanner, including but not limited to software, text, graphics, logos, and trademarks, are owned by or licensed to CarbScanner and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes in accordance with these Terms.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or if we decide to discontinue the Service. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall continue to apply.

10. Service Changes, Discontinuation & No Refunds

The owner of CarbScanner may modify, suspend, or discontinue the Service (in whole or in part) at any time, for any reason, with or without notice. We do not guarantee that any feature, content, or functionality will be available at any time or for any duration.

If the Service is modified, suspended, or discontinued, you are not eligible for any refund, reimbursement, or credit, to the extent permitted by applicable law. If you purchased a subscription through a third-party platform (such as the Apple App Store or Google Play), any refunds, if required, are handled solely in accordance with that platform’s policies.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be accurate, reliable, uninterrupted, secure, or error-free, or that any defects will be corrected.

12. Limitation of Liability

To the maximum extent permitted by law, CarbScanner and its owners, developers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Service shall be limited to the amount you have paid for access to the Service in the three (3) months immediately preceding the event giving rise to the claim, or, if you have not paid any amount, to the extent permitted by law.

13. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in our Service or legal requirements. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of the Service after any changes means you accept the updated Terms. If you do not agree with the changes, you must stop using the Service.
